The number of children with chronic critical illness (CCI) is a growing population in the United States. A defining characteristic of this population is a prolonged hospital stay. Our study assessed the proportion of pediatric patients with chronic critical illness in U.S. hospitals at a specific point in time, and identified a subset of children whose hospital stay lasted for months to years. The potential harms of a prolonged hospitalization for children with CCI, which include over treatment, infection, disruption of (...) family life, and the intensive utilization of resources—combined with the moral distress experienced by the clinicians who care for the children, suggest the need for ethical analysis of this growing issue to identify actions that could be taken at the clinical and health systems levels to reduce the harms associated with prolonged hospital stay.In this article we present three real cases from our study that involved a very long hospital stay. We applied a framework developed by Mackenzie, Rogers, and Dodds to analyze inherent, situational, and pathogenic vulnerabilities to examine the ways that interventions intended to remedy one source of harm for the children in our cohort inadvertently created other harms. We examined the complex ways that children with protracted hospitalization are vulnerable to the choices made by their family and clinicians, as well as by healthcare systems and communities. Finally, we used this analysis to summarize actions and ethical responses to this growing patient population. Such an understanding is essential to making clinical and ethical decisions that arise for children who are at risk for a very long stay in the hospital. (shrink)

In every philosopher’s career, there comes a time to look back on accomplishments, assess achievements, evaluate one’s place in a canon that dates to an era when Ancient Greeks still roamed the Earth. Perhaps many of you have wondered when I’d finally get around to doing this. Sadly, this is not the night for that splendid occasion. Do not pretend to hide your disappointment. Also, do not hesitate to point fingers. Believe me when I tell you that I would take (...) great delight in reporting to you my accomplishments, achievements, and place in the canon. If you don’t believe me, ask anyone who knows me well, or, at any rate, has spent a few minutes in conversation with me, or, maybe, has simply observed me in conversation with someone else. They’ll tell you that I am uniquely suited to fete myself, and take obvious pleasure spreading the good word to others. Alas, I have been enlisted to concentrate my philosophical powers on a topic less interesting than myself. My focus? A woman named Ruth Millikan. For philosophers, mention of the Book of Ruth directs thoughts not to the Old Testament, but to LTOBC. This is a shame, because Ruth’s Old Testament book is quite short, as books go, and tells a heartwarming story of redemption and devotion – virtues that receive hardly any mention in LTOBC. Now that I think about it, Ruth’s later books and articles mark a significant departure from the plot line in that first Book of Ruth’s. Gone are references to Bethlehem and Moab, and in their place lurk hoverflies and push me pull yous, but more on these matters in a moment. I want first to turn my finely tuned and oft picked philosophical nose to LTOBC – unquestionably Professor Millikan’s magnum opus . Here’s a little known fact. Originally, LTOBC had a different title, requiring a different acronym. If she hadn’t taken her editor’s advice, we’d be speaking of BLTOBC, which stood for Bacon, Lettuce, and Tomato on Blueberry Cobbler. There’s something down home and grannyish about this title, and Ruth deserves credit for trying to entice readers with the promise of good old fashioned, feather plucked, farm food, but, as her editor was quick to note, bacon, lettuce, and tomato have no more place on blueberry cobbler than they do on cherry cobbler, and so BLTOBC might as well be BLTOCC, and with no reason to prefer one title to the other, best just to forget about the bacon.. Hartry Field has proposed a fundamental division of theories of linguistic and mental content into those that do, and those that don’t, give a central role to ‘that’-clause ascriptions. Here I investigate the commitments of theories that (in accord with Field’s position) deny ‘that’-clause ascriptions a central role, but (in contrast to Field’s position) give truth conditions a central role. Such non-oblique truth-conditionalism promises significant advantages. However, the stance is costlier than it may appear. Non-oblique truth-conditionalists, I argue, must renounce (...) a priori entitlement to schemas of disquotation that are presupposed when theories of content are put to metaphysical or epistemological use. As case studies, I discuss two theories that might seem to exemplify non-oblique truth-conditionalism: David Chalmers’s two-dimensionalist theory of content and Ruth Millikan’s teleosemantics. Just about every theorist holds that vague terms are context-sensitive to some extent. What counts as ?tall?, ?rich?, and ?bald? depends on the ambient comparison class, paradigm cases, and/or the like. To take a stock example, a given person might be tall with respect to European entrepreneurs and downright short with respect to professional basketball players. It is also generally agreed that vagueness remains even after comparison class, paradigm cases, etc. are fixed, and so this context sensitivity does not solve (...) the problems with vague terms. In this paper, I briefly sketch the main features of my broadly contextualist account of vagueness, that of the late Ruth Manor, and that of Agustín Rayo, showing how the three accounts relate to, and reinforce, each other, noting a seeming difference. A key item used to articulate my own view is David Lewis's notion of conversational score. This is used to track which borderline cases have been called in the course of a conversation. Manor alludes to Lewis's notion of accommodation, a key aspect of the kinematics of conversation, and Rayo invokes Stalnaker's notion of common ground. I'll show how the conversational score could be employed to develop and extend their views, showing how vague terms, as they construe them, are (or can be) deployed in conversation, consistent with both the underlying indeterminacy of the terms and normal communicative goals. To help develop all three views further, I invoke Craige Roberts's notion of Retrievability, a tool developed to show how definites, such as definite descriptions, singular pronouns, and proper names, are deployed in conversation, in a Lewis-style scorekeeping framework. This, I think, is exactly the right way to understand conversations in what Manor calls non-sorities situations and, to invoke my own view, in sorites situations as well. (shrink)

This article presents a sociological analysis of the changing role of women in the Catholic church over the past twenty years. The theoretical framework is drawn from The Social Construction of Reality by Peter Berger and Thomas Luckmann. Data are derived from the documents of Vatican II, the revised Code of Canon Law, research from 1965 to the present, and exploratory interviews with Catholic women recently appointed as church administrators. The commitment to evidence-based practice in clinical psychology requires scientific investigation of the effects of treatment and mechanisms of change. Empirical evidence suggests that mindfulness-based treatments provide clinically meaningful improvement for people suffering from many important problems, including depression, anxiety, pain, and stress. However, the processes of change that produce these beneficial outcomes are not entirely clear. Central questions include whether mindfulness training leads to increases in the general tendency to respond mindfully to the experiences of daily life, and if (...) so, whether these changes are responsible for the improvements in mental health that are often observed. Answering these questions requires methods for assessing mindfulness. Several tools for this purpose are now available and early evidence suggests that they are useful and informative, despite shortcomings that require additional work. This paper summarizes the rationale for mindfulness questionnaires, the methods used to construct them, and research findings on their utility. Challenges related to maintaining consistency with Buddhist conceptions of mindfulness while applying psychological research methods to the study of its assessment are discussed. (shrink)

Futility disputes are increasing and courts are slowly abandoning their historical reluctance to engage these contentious issues, particularly when confronted with inappropriate surrogate demands for aggressive treatment. Use of the judicial system to resolve futility disputes inevitably brings media attention and requires clinicians, hospitals, and families to debate these deep moral conflicts in the public eye. A recent case in Minnesota, In re Emergency Guardianship of Albert Barnes, explores this emerging trend and the complex responsibilities of clinicians and hospital administrators (...) seeking to replace an unfaithful surrogate demanding aggressive therapy. Use of the courts requires the coordinated commitment of significant institutional resources, management of intense media scrutiny and individual and organizational courage to enter the unpredictable world of litigation. Given the dearth of legislative guidance on medical futility, individual clinicians and institutions will continue to bear the difficult responsibility for resolution of individual futility disputes. The Barnes case illustrates how one institution successfully used the judicial system to replace an unfaithful surrogate, cease the provision of inappropriate aggressive care, and stimulate a community dialogue about appropriate care at the end of life. The recent Minnesota case of In re Emergency Guardianship of Albert Barnes illustrates an emerging class of cases where a dispute between a family proxy and a hospital over “medical futility” requires legal resolution. The case was further complicated by the patient’s spouse who fraudulently claimed to be the patient’s designated health care proxy and who misrepresented the patient’s previously expressed treatment preferences. Barnes demonstrates the degree of significant administrative and institutional support to the health care team, ethics consultants, and (...) futility committees that is required when a futility dispute escalates to the need for judicial resolution. An institutional futility policy, especially one that is endorsed by other regional medical centers and organizations, is an important foundation for a hospital that seeks judicial support in a dispute over medical futility in end of life care. This scholarly renditionof Jaspers' ´Introduction´ to his seminal work "The Great Philosophers" stays to theoriginal German text as true possible by upholding its idiomatic cultural expressions, complex sentence structure, and nuanced particularities provided that clarity of communication can be maintained. The substantive contents and the significance of this text, whose principal topic is greatness, are outlined here. The aim of this contribution is to critically explore the understanding, the goals and the meaning of education in the philosophy of education by Jean-Jacques Rousseau. In his educational novel Emile: or On Education [Emile ou De l’éducation] (1762) he depicts his account of the natural education. Rousseau argues that all humans share one and the same development process which is independent of their social background. The central contention of this book is that second-order logic has a central role to play in laying the foundations of mathematics. In order to develop the argument fully, the author presents a detailed description of higher-order logic, including a comprehensive discussion of its semantics. He goes on to demonstrate the prevalence of second-order concepts in mathematics and the extent to which mathematical ideas can be formulated in higher-order logic. He also shows how first-order languages are often insufficient to codify (...) many concepts in contemporary mathematics, and thus that both first- and higher-order logics are needed to fully reflect current work. Throughout, the emphasis is on discussing the associated philosophical and historical issues and the implications they have for foundational studies. For the most part, the author assumes little more than a familiarity with logic comparable to that provided in a beginning graduate course which includes the incompleteness of arithmetic and the Lowenheim-Skolem theorems. In the ´Introduction´ to "The Great Philosophers" Karl Jaspers explores the criteria for recognizing human greatness in general and in philosphers in particular. He comments on the historical process related to the selection and grouping of great philosophers. Jaspers acknowledges the questionable aspect of greatness, yet he affirms that such distinction is indispensable. The 1957 English translation by Ralph Mannheim and Hannah Arendt of Jaspers' Die Grossen Philosophen and all its subsequent editions did not include this Introduction. The study considers the topic of linguistic register by examining how schoolchildren, adolescents, and adults vary the texts that they construct across the dimensions of modality and genre . Although register variation is presumably universal, it is realized in language-specific ways, and so our analysis focuses on Israeli Hebrew, a language that evolved under peculiar socio-historical circumstances. An original procedure for characterizing register — as low, neutral, or high — was applied to four text types produced by the same speaker-writers. (...) We found that across all age groups, “neutral“ items constituted the bulk of the material, and that the lexicon accounted for some 80% of variation. Developmentally, we found that acquisition of fully flexible register variation continues beyond adolescence. Finally, we observed that text types range on a cline from everyday colloquial usage in oral narratives to more formal, high-level language in written expository essays. These results are discussed in light of their implications for the nature of register variation, later language development, and the sociolinguistics of contemporary Hebrew. (shrink)

While it is uncontroversial to point to the liberal roots of feminism, a major issue in English-language feminist political thought over the last few decades has been whether feminism's association with liberalism should be relegated to the past. Can liberalism continue to serve feminist purposes? This book examines the positions of three contemporary feminists - Martha Nussbaum, Susan Moller Okin and Jean Hampton - who, notwithstanding decades of feminist critique, are unwilling to give up on liberalism. This book examines why, (...) and in what ways, each of these theorists believes that liberalism offers the normative and political resources for the improvement of women's situations. It also brings out and tries to explain and evaluate the differences among them, notwithstanding their shared allegiance to liberalism. “Teleosemantics and Pushmi-Pullyu Representations” (call it “TP-PR,” this journal 2014 79.3, 545–566) argues that core teleosemantics, particularly as defined in Millikan (Language, thought and other biological categories, MIT Press, Cambridge, 1984, J Philos 86(6):281–297, 1989, White queen psychology and other essays for Alice, MIT Press, Cambridge, 1993, Philosophical perspectives, Ridgeview Publishing, Alascadero, 1996, Varieties of meaning, MIT Press, Cambridge, 2004–2008), seems to imply that all descriptive representations are at the same time directive and that directives are at the same time (...) descriptive, hence that all representations are pushmi-pullyu representations. A pushmi-pullyu representation is at once indicative and imperative, telling both what the case is and what to do about it. The usefulness at all of the notion of a pushmi-pullyu representation is then questioned. I have recently found several new papers, dissertations, discussions, in which TP-PR is treated as definitive. However, the conclusions of TP-PR rest on misunderstandings of my position, so although the date is late, clarification seems still to be in order. I will indicate a few significant corrections that need to be made to TP-PR’s description of my position (originally called “biosemantics”) and explain central features of biosemantics that are omitted in TP-PR’s description of basic teleosemantics and which are incompatible with the main argument and conclusions of TP-PR. I will try to clarify and explain the value of the notion of a pushmi-pullyu representation. (shrink)

This paper uses neo-Fregean-style abstraction principles to develop the integers from the natural numbers (assuming Hume’s principle), the rational numbers from the integers, and the real numbers from the rationals. The first two are first-order abstractions that treat pairs of numbers: (DIF) INT(a,b)=INT(c,d) ≡ (a+d)=(b+c). (QUOT) Q(m,n)=Q(p,q) ≡ (n=0 & q=0) ∨ (n≠0 & q≠0 & m⋅q=n⋅p). The development of the real numbers is an adaption of the Dedekind program involving “cuts” of rational numbers. Let P be a property (of (...) rational numbers) and r a rational number. Say that r is an upper bound of P, written P≤r, if for any rational number s, if Ps then either s<r or s=r. In other words, P≤r if r is greater than or equal to any rational number that P applies to. Consider the Cut Abstraction Principle: (CP) ∀P∀Q(C(P)=C(Q) ≡ ∀r(P≤r ≡ Q≤r)). In other words, the cut of P is identical to the cut of Q if and only if P and Q share all of their upper bounds. The axioms of second-order real analysis can be derived from (CP), just as the axioms of second-order Peano arithmetic can be derived from Hume’s principle. The paper raises some of the philosophical issues connected with the neo-Fregean program, using the above abstraction principles as case studies. (shrink)

This is a comparison of graduate students attitudes in Spain and the United States on the issue of universal versus relativist ethics. The findings show agreement on fundamental universal values across cultures but differences in responses to behavioral ethics within the context of entrepreneurial dilemmas.

Pervasive though it is in modern life, the concept of self‐esteem is often viewed with distrust. This paper departs from an idea that was recently aired by Richard Smith: that we might be better off without this concept. The meaning of self‐esteem is explored within four ‘homes’: the self‐help industry, social science, therapy and education. It is suggested that the first two use a ‘simple’ concept of self‐esteem that indeed we are better off without. This concept eliminates the distinction between (...) truthfulness and delusion, and relies on a chimera of quantifiability. The much richer concept of situated self‐esteem is explored, and it is argued that low self‐esteem in children should command the attention of educators. Teachers should address this through education and communication, and reject the idea of boosting self‐esteem through a content‐free curriculum. (shrink)

Correctly understood, teleosemantics is the claim that “representation” is a function term. Things are called “representations” if they have a certain kind of function or telos and perform it in a certain kind of way. This claim is supported with a discussion and proposals about the function of a representation and of how representations perform that function. These proposals have been retrieved by putting together current descriptions from the literature on neural representations with earlier explorations of the features common to (...) most things we are inclined to call representations as these were assessed in Millikan. Of interest is the degree to which these independent sources converge. I conclude that there is no need to employ any new or technical sense of the term “representation” for it to play an important role in neuroscience. (shrink)

For the past four decades, Anglo-American legal philosophy has been preoccupied – some might say obsessed – with something called the “Hart-Dworkin” debate. Since the appearance in 1967 of “The Model of Rules I,” Ronald Dworkin’s seminal critique of H.L.A. Hart’s theory of legal positivism, countless books and articles have been written either defending Hart against Dworkin’s objections or defending Dworkin against Hart’s defenders. My purpose in this essay is not to declare an ultimate victor; rather it is to identify (...) precisely the core issue around which the debate is organized. Is the Hart-Dworkin debate, for example, about whether the law contains principles, as well as rules? Or does it concern whether judges have discretion in hard cases? Is it about the proper way to interpret legal texts in the American legal system? Or is it about the very possibility of conceptual jurisprudence? Although trying to capture the essence of a philosophical debate can be tricky, I think that there is an important unity to the Hart-Dworkin debate that can be described in a relatively straightforward manner. I suggest that the debate is organized around one of the most profound issues in the philosophy of law, namely, the relation between legality and morality. Dworkin’s basic strategy throughout the course of the debate has been to argue that, in one form or another, legality is ultimately determined not by social facts alone, but by moral facts as well. This contention directly challenges, and threatens to undermine, the positivist picture about the nature of law, in which legality is never determined by morality, but solely by social practice. As one might expect, the response by Hart and his followers has been to argue that this dependence of legality on morality is either merely apparent or does not, in fact, undermine the social foundations of law. The Hart-Dworkin debate, I also try to show, is not a monolithic entity. In the second half of the paper, I describe how Dworkin modified his critique to circumvent the responses of Hart’s followers, thereby inaugurating a new phase in the debate. Virtually no attention, however, has been paid to this latter challenge, which is especially surprising given that none of the previous positivistic defenses are helpful against it. I then sketch out a possible response positivists might offer to this extremely powerful objection. (shrink)

Happiness is a large idea. It looms enticingly before us when we are young, delivers verdicts on our lives when we are old, and seems to inform a responsible engagement with children. The question is raised: do we want this idea? I explore a distinction between rich and poor conceptions of happiness, suggesting that many sceptical arguments are directed against the latter. If happiness is to receive its teleological due, recognised in rather the way Aristotle saw it, as a final (...) end that crucially lacks specificity, it must be richly conceived without denying the significance of unhappiness or despair. I suggest that Aristotle's Nicomachean Ethics is ‘completed’ in a distinctively Aristotelian sense by authors like George Eliot and Virginia Woolf. Substantial excerpts are discussed to show how ideas like ‘making others happy’ may be richly conceived. By treating literary examples (poetically articulated, sensually received) as ineliminable reference points in our thinking, we open up a new way of imagining relationships in education. We attend communally, conversationally and often argumentatively to the dramas of human life. This, I argue, is how we grapple with large ideas and bring about ethical learning. (shrink)

: Because an influenza pandemic would create the most serious hardships for those who already face most serious hardships, countries should take special measures to mitigate the effect of a pandemic on existing social inequalities. Unfortunately, there is little evidence that anybody is thinking about that.

This paper aims to call into question the customary division of logically revisionary responses to the truth-theoretic paradoxes into those that are “substructural” and those that are “ structural.” I proceed by examining, as a case study, Beall’s recent proposal based on the paraconsistent logic LP. Beall formulates his response to paradox in terms of a consequence relation that obeys all standard structural rules, though at the price of the language’s lacking a detaching conditional. I argue that the same response (...) to paradox can be given using a consequence relation that preserves detachment rules for a conditional, though at the price of restricting structural rules. The question “Is paradox being blocked by invoking a substructural consequence relation?” is thus ill-posed. The lesson of this example, I conclude, is that there is no useful explication of the idea of a substructural approach to paradox. (shrink)

In attempting to derive irreversible macroscopic thermodynamics from reversible microscopic dynamics, Boltzmann inadvertently smuggled in a premise that assumed the very irreversibility he was trying to prove: ‘molecular chaos.’ The program of ‘Einselection’ within Everettian approaches faces a similar ‘Loschmidt’s Paradox’: the universe, according to the Everettian picture, is a closed system obeying only unitary dynamics, and it therefore contains no distinguishable environmental subsystems with the necessary ‘phase randomness’ to effect einselection of a pointer observable. The theoretically unjustified assumption of (...) distinguishable environmental subsystems is the hidden premise that makes the derivation of einselection circular. In effect, it presupposes the ‘emergent’ structures from the beginning. Thus the problem of basis ambiguity remains unsolved in Everettian interpretations. (shrink)

This study contributes to our understanding of how work-related values, including ethics, are connected with the readiness to change in Estonian organizations. Research in Estonian companies involved 747 respondents. The author examined the influence of work-related values on attitude towards change and organizational learning. Empirical research in Estonian organizations indicates that work-related values predict attitude towards change and organizational learning. This study indicates the need for ethical conduct to achieve a competitive advantage in Estonia. Guidelines for managers and a model (...) of value-based change management are subsequently developed.
